Rules and Regulations for the Production and Sale of ARP Goods

Fanmade Goods

  • Rental Businesses: The use of ARP products (henceforth referred to as "Official") in rental businesses is highly discouraged. In the event of lawsuits, damage claims, or disputes, ARP will not be held responsible for any outcomes.
  • Commercial Production: The commercial production of Fanmade Goods for sale is strictly prohibited. However, producing giveaway items (e.g., keychains, cards, etc.) for free distribution is allowed.
    • Creators may ask recipients to cover shipping expenses for giveaway items.
  • Group Orders / Cost-Sharing (Group Buys): Cost-sharing to produce Fanmade Goods for personal use (not as a giveaway) is permitted for a maximum of 10 pieces.
  • Use of Official Assets: Modifying or adapting Official resources to create Fanmade Goods is strictly prohibited under any circumstances (e.g., using official artwork or photos of L2D/3D models to manufacture products).
  • Reselling Official Goods: The resale or passing on of Official goods is tolerated, provided that the price does not exceed the original Official retail price. However, in the event of lawsuits, damage claims, or disputes, ARP will accept no responsibility whatsoever for the outcomes.
  • Identical Designs: Producing Fanmade Goods that feature the exact same designs as those distributed by the Official source is strictly prohibited. Whether for commercial or personal use, as this constitutes copyright infringement.

Doujinshi / Fanfiction

This section applies if the produced work is in a printed format, such as Doujinshi books or fanfiction.

  • Print Limits: Works can be produced and sold up to a maximum of 500 copies per cover or title.
  • Digital Distribution: Distribution in digital formats (E-Books) is strictly prohibited.
  • Donations vs. Paywalls: Accepting donations/tips for writing is permitted; however, putting content behind a paywall (such as using locked/paid coins on platforms) is strictly prohibited.
  • 18+ / Mature Content: Writing 18+ content for commercial purposes is strictly prohibited, as it constitutes a legal offense under Section 287 (1) and (2) of the Criminal Code.

Cosplay

  • Income Cap: Cosplayers can generate revenue from all formats up to a maximum of 20,000 THB per character. This limit is calculated based on gross revenue before deducting expenses and taxes.
  • Cosplay Rentals: Outfitting/Rental services are subject to the same income cap rule stated above.
  • Official Merchandise in Rentals: Utilizing items produced and sold by the Official source, such as T-shirts, for commercial purposes like cosplay rentals is strictly prohibited.
  • Multiple Versions: If a character has multiple outfits/versions, they will all be counted as the same single character.
    • Example: If you cosplay Dacapo, the combined revenue from Dacapo (Original Costume) + Dacapo (Casual Costume) + Dacapo (Graviton Costume) must not exceed 20,000 THB.
  • Official Clothing Designs: Reproducing official clothing designs, such as the Vtuber T-Shirt Collection, is strictly prohibited. Any unauthorized reproduction, whether for cosplay or any other purpose, will be considered an infringement on the intellectual property of Realic Production Co., Ltd.

Commission

  • Accepting and Commissioning Work: Accepting or hiring out commissions for various media featuring the agency's VTubers (such as hiring someone for fanart, writing novels, etc.) is permitted.

Fan Projects

This includes Fan Projects, Fan Cafes, and Birthday Cafes.

  • Decorations: Do not use photos of the VTubers' models for any decorations; only newly drawn fanart is permitted.
  • Background Music (BGM): If playing the VTubers' music, please only use songs copyrighted by the ARP agency. Playing uncopyrighted or unauthorized cover songs is highly discouraged.
  • Fundraising & Tiered Giveaways: Fundraising/Donations for Fan Projects (cafes, charity donations, billboard projects, etc.) are permitted. However, it is strictly prohibited to offer giveaways as an incentive for reaching specific donation thresholds.
    • Prohibited Example: "Donate 100 THB to receive a sticker" or "Donate 500 THB to receive a sticker and a keychain."
    • Giveaways can be distributed at the Fan Project event, but they must not be tied to any fundraising or donation conditions.

1:1 Life-Size Standees

  • The agency will consider these on a case-by-case basis depending on the intended purpose. Organizers can contact the agency to inquire and request permission.
  • The artwork used must be newly drawn; using official illustrations is strictly prohibited under all circumstances. Additionally, the words "Fanmade / Not for Sale" must clearly appear on the artwork being produced.
  • Regarding the final disposition of the standee, the organizers may keep it themselves, hold a lucky draw for attendees, or use other methods. It does not need to be sent back to the agency. However, putting the standee up for auction, even for charity, is strictly prohibited.

Photobooths

  • Photobooths are permitted, but organizers must email the event details and the artwork to be used to the agency at contact@realic.net.
  • Because photobooths require charging a fee to take photos, it is regarded as profiting from the artists' images. Therefore, the company will only grant permission if the photobooth is part of an official talent's birthday project.

Video/Billboard Fan Projects

  • Clips from the VTubers' livestreams may be used. However, any accompanying illustrations/graphics must consist entirely of newly drawn fanart.

Note: The agency requests your cooperation in ensuring that all fundraising is conducted with the utmost transparency. In the event of lawsuits, damage claims, or disputes, ARP will accept no responsibility whatsoever for the outcomes.

Generative AI

  • The company strictly prohibits the use of intellectual property under the name Algorhythm Project for training datasets for Artificial Intelligence systems (Generative AI) in any form. This includes modifying, reproducing, commercializing, or using it for any other purpose that violates company policy.
  • Utilizing AI to create works or content that defames or damages the reputation of the talents is absolutely prohibited.
